What is corruption?


The etymological approach to the content of the term of “corruption” allows us to define the word as “bribery”, “bribe”, based on the Latin word “corruptio”. In Roman law there is also the term "corrumpire", which was interpreted in the most general way, as "breaking, spoiling, destroying, damaging, falsifying, bribing" and denoted the corresponding illegal action. The explanatory dictionary of the Russian language characterizes corruption as briberу of officials or politicians.


The Law of the Republic of Kazakhstan “On Combating Corruption” gives the following definition of corruption - it is “not legally provided for personally or through intermediaries to accept property benefits and advantages by persons performing public functions, as well as by persons equivalent to them, using their official powers and related their opportunities or other use of their powers to obtain property benefits, as well as bribing these persons by unlawfully providing them with physical and legal persons associated benefits and advantages. "


What is a bribe?


The material values ​​accepted by the official (objects, money, services, other property benefits) for an action or inaction in the interests of a bribe-giver that this person could not or should not have committed due to his official position is a bribe.



The act of transferring and accepting a bribe is illegal in most countries and is subject to the Criminal Code. Receiving and giving bribes to public servants is a classic manifestation of corruption.


The Criminal Code of the Republic of Kazakhstan provides for two types of crimes related to a bribe: Article 366.Receiving a bribe and Article 367. Giving a bribe.


What is backhander?


Illegal transfer to a person performing managerial functions in a commercial or other organization of money, securities or other property, as well as the illegal provision of property services to him for using his official position, as well as for general patronage or connivance in the service in the interests of the person exercising bribery is called backhander in the Criminal Code of the Republic of Kazakhstan (Article 253).
